Statement of Condition & Compliance

Prior to acquiring a new commercial real estate asset, it is imperative that stakeholders know 1) the condition of the Storm Water System (”SWS”) they are inheriting, and, 2) that there is a prescriptive Stormwater Management Plan ("SMP") in place as mandated by the EPA.

Regulatory Requirements

The US EPA requires developed sites larger than one acre have an SMP, annual inspections, and regular maintenance. These functions are typically performed by stormwater specialty firms familiar with Federal codes and municipal reach standards, who can keep clients compliant. RCS expertise includes asset due diligence, acquisition and financing compliance, and post-acquisition code compliance, for a fraction of the cost of typical engineering firms. 


In working with our clients, egregious Clean Water Act violations will be avoided. Historically, non-compliance has resulted in Federal fines as large as tens-of-millions of dollars. Building collapses and other issues have resulted in criminal and civil charges while highly destructive environmental disasters have resulted in ESG and headline exposure. Simply stated, our stewardship will GUARANTEE statutory and lender compliance.

An Ounce of Prevention....

Most of our commercial plans are extremely inexpensive. A standard Statement of Compliance & Condition ("SCC") is typically less than a basis point of  the facility acquisition cost. Ongoing compliance plans are more bespoke but regulatory inspection and filing is also typically less than a basis point.
